Warren Aircraft LLC
Used Aircraft Limited Warranty |
Warren Aircraft LLC expressly warrants its rebuilt aircraft, (exclusive of items listed, referred to, or defined in "Exclusions"), to be free from defects in material and workmanship under normal use and service for one (1) year or 400 flight hours, whichever first occurs, commencing on __________ (date), and _____ (hours) airframe hours. Warren Aircraft LLC’s obligation is to repair or replace, at its option, defective part(s) within the applicable warranty period. (Replacement parts are only warranted for the remainder of the applicable warranty period.) Warren Aircraft LLC’srepair or replacement of defective parts under its Used Aircraft Limited Warranty will only occur at a designated Warren Aircraft LLC service center, without charge for parts or labor for removal, installation, and/or actual repair of such defective parts.
LIMITSTo the extent allowed by applicable law, WARREN AIRCRAFT LLC’S USED AIRCRAFT LIMITED WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED, IN FACT OR BY LAW, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE REMEDIES OF REPAIR OR REPLACEMENT ONLY AT AUTHORIZED LOCATIONS, ARE THE ONLY REMEDIES UNDER THIS LIMITED WARRANTY. WARREN AIRCRAFT LLC DISCLAIMS ANY AND ALL OBLIGATIONS OR LIABILITY, WHETHER IN CONTRACT OR IN TORT (NEGLIGENCE), INCLUDING LOSS OF USE, LOSS OF TIME, LOSS OF PROFIT, INCONVENIENCE, COMMERCIAL LOSS; OR ANY OTHER DIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES. WARREN AIRCRAFT LLC’S USED AIRCRAFT LIMITED WARRANTY IS IN LIEU OF ANY OTHER OBLIGATION OR LIABILITY OF WARREN AIRCRAFT LLC OF ANY NATURE WHATSOEVER by reason of the sale, lease, or use of such Used Aircraft, and Warren Aircraft LLC neither assumes nor authorizes anyone to assume for it any other obligation or liability in connection with such Used Aircraft.
NONTRANSFERABILITYWarren Aircraft LLC’s Used Aircraft Limited Warranty is not transferable and only applies to the person or entity identified by Warren Aircraft LLC Used Aircraft Purchase Agreement #_________.
The provisions of Warren Aircraft LLC’s Used Aircraft Limited Warranty do not apply to any used aircraft part, avionic, or optional equipment which has not been used, maintained, or operated in accordance with Warren Aircraft LLC’s or other applicable manuals, bulletins, or other written instructions, or which has been subjected to misuse, negligence, or accident, or which was installed, repaired, or altered other than by Warren Aircraft LLC in any way so as, in the judgment of Warren Aircraft LLC, to affect adversely its or their performance, stability or reliability, or to normal maintenance services, and the replacement of service items made in connection with such services or required as maintenance or to normal deterioration of soft trim and appearance items due to wear and exposure.
This warranty does not cover damage resulting from accident, misuse, abuse, neglect, fire, water, hail, lightening, and any other hazard or act of God, improper storage, unauthorized modification, failure to comply with the Flight Manual guidelines, or any other cause beyond the range of intended use except as deemed appropriate by Warren Aircraft LLC.
Engines, Engine Accessories, Engine Components and avionics are excluded from coverage.
Optional equipment which has been installed, repaired, or altered not in accordance with Warren Aircraft LLC approved installation instructions following acceptance of the used aircraft by warranty recipient is excluded from coverage.
Normal Maintenance/Services
Engine adjustments, cleaning, washing, polishing, control rigging, normal mechanical systems adjustments, scheduled inspection flat rates, overtime labor, standby charges, travel and ferrying related expenses to obtain warranty coverage, modifications, improvements, rental units (including installation and removal labor), consumables (all fluids and gasses) and normal service items (brake lines, filters, belts, tires, hoses, light bulbs, periseals, etc.) are examples of normal maintenance and service items excluded from coverage.
Normal deterioration of soft trim and appearance items (paint, upholstery, and related materials) due to wear and exposure is excluded from coverage.
Service Bulletins, Service Letters, and Airworthiness Directives are not covered.
Damage to the airframe, airframe mounted components, avionics, or optional equipment which has been damaged as a result of misuse, negligence, accident, or normal operational hazards is excluded from coverage.
No other warranty, written or verbal is authorized by Warren Aircraft LLC. This warranty applies to aircraft rebuilt according to the terms of the sales agreement only. This warranty is valid only if signed by the owner of the aircraft and an authorized Warren Aircraft LLC employee. |
